Contracts

Whenever two or more parties make an agreement about a business matter, they have made a contract.  That includes an agreement to sell something, buy something, provide security, do a job and a host of other activities. A free market economy, such as the USA, runs on contracts and contractual principles. Our firm handles all kinds of contracts, including those  involving employment, real estate sales (including contracts for deed), sales of businesses, and a wide variety of other matters. We can help you by drafting contracts, advising you on what you can expect from the other party under a contract, sorting through your own obligations under a contract, and if necessary, assisting you in litigation in contractual matters.

Guardianship &
Conservatorship

A Guardian is a person who makes decisions for someone who is unable to make their own decisions, either for reasons of age or incompetence. A conservator is someone who manages the finances and property for someone who is unable to manage their own affairs for reasons of age or incompetence. Sometimes, one person is both Guardian and Conservator, and sometimes only one, but not both, is needed. A person only becomes Guardian or Conservator upon appointment by the Court after certain requirements are met, such as passing a background check and obtaining bond. After appointment, the Guardian or Conservator must file an annual report with the Court describing the actions taken on behalf of the protected party.

Real Estate

Real estate is a diverse area of the law. We can help answer your questions about deeds, contracts for deed, easements, platting, zoning, covenants, mortgages, foreclosures, purchase agreements, title insurance,  boundary disputes, and any other real estate transaction. We can also draft and file many of these real estate documents for you. Our practice includes residential real estate, commercial property, and agricultural property.

Powers of
Attorney

Creating a power of attorney is an important part of any estate plan.

A power of attorney is a document appointing someone who can assist you in the management of your affairs if your ability to do it yourself is impaired by reason of health or accident, including making financial and health care decisions for you in case you become incapacitated.

Everyone who has significant assets or family to protect should consider what they would want to happen in the event of their untimely death. For many people, an estate plan consisting of a simple will and a power of attorney meets their needs. Those with greater assets, tax issues or complex family situations (blended families, children born outside of marriage, second or later marriages, and other situations) may be in need of more complex arrangements, such as revocable or irrevocable trusts. We can walk you through the pros and cons of various estate plans and help you choose a plan that fits the needs of your particular situation.

Probate & Trust 
Administration

Probate is the process of administering a deceased person's estate, either with a will or without one. The first step in any probate is the appointment of the personal representative (also known as an executor), who is then charged with the duty of collecting assets of the estate, paying liabilities, and distributing the remaining assets to the heirs or beneficiaries. Probate is not always required, however, but we can analyze your situation and advise you on whether it is necessary.

If the deceased has established a trust as his or her primary estate plan, probate is often unnecessary. We can assist with the administration of the trust and winding up the affairs of the trust when it terminates.
